Trade Secrets

K&F traced trade secret information from a former employee's old work computer to his home computer an on to work stations and network servers of the new employer. Along the way K&F forensically examined numerous laptop and desktop computers as well as high capacity, RAIDed network servers. In addition, K&F recovered dozens of backup tapes and sifted through hundreds of thousands of data files and over 9 million e-mails from which it produced relevant evidence of purloined trade secrets. K&F acquired, de-duped, searched and produced e-mails considered relevant to the case.

Assertion of Claim and Document Management

K&F quantified delay damages at $24 million for a Fortune 500 manufacturer whose contracts had been impacted by numerous constructive changes. K&F used its knowledge of relational databases to develop a document indexing and retrievel system for over 400,000 pages of contract documents that integrated with its quantification model and drove a parametric methodology for determining that the effect of design changes was to add more than three years and 100,000 man-hours to client's design and development process. The parametric model was later used by the client and its customer to negotiate contract modifications for the increase engineering effort caused by the changes. Furthermore, the model was ultimately accepted for estimating the consequence of the design changes on production after K&F demonstrated that more traditional methods, such as CPM, were inappropriate in this particular circumstance.

Neutral Expert

K&F was retained as a neutral expert to assist with the search and production of electronic data from laptops, workstations, RAIDed network servers and back-up systems, including over 2 million e-mails on client systems and e-mail servers following a prescribed production protocol designed to protect privileged information. K&F acquired, de-duped, searched, and produced 1,500 e-mails considered relevant to the case.
