for Aspen Publishers 2007 Edition of Construction Law Update

ALPHARETTA, Ga.—June 25, 2007 – Greg Fordham, a founder of K&F Consulting Inc., and an expert witness in many state and federal cases involving e-discovery and computer forensics, is a contributing writer for the 2007 Construction Law Update.            

Published by Aspen Publishers, and edited by Neal J. Sweeney, a partner with Kilpatrick Stockton LLP in Atlanta, the nearly 600 page Construction Law Library book addresses a broad range of issues associated with construction law, government contracts and other industry-related matters including dealing with electronic data.            

"Some of the issues the construction industry faces, such as unexpected subsurface conditions, are as old as dirt,"Sweeney noted.            

"However the book also addresses the relatively new, but exponentially expanding challenge of dealing with the overwhelming amount of electronic data generated on every project in the form of e-mail, electronic document retention systems and electronic design  --  all of which raise critical issues about data management and records retention policies," Sweeney added.              

A similar update has been published each year for the past 15 years.              

Fordham’s contribution reviews e-discovery matters following the 2006 changes to the Federal Rules of Civil Procedure (FRCP).            

According to Fordham the recent changes to the Federal rules will probably have little effect on those well-versed with digital evidence. But he noted that there are risks for those who are not yet skilled in cyber litigation.
                                               
"The new rules not only unlock the door to electronic discovery, they open it and provide passage instructions," he said.            

Fordham says the use of electronic data in litigation continues to gain increased attention, interest and application. Currently more than 95 percent of relevant evidence is in electronic form with a significant amount never being reduced to paper.            

"Computerized applications are the everyday tools used from concept inception to final payment by investors, developers, designers, builders, subcontractors and suppliers,” Fordham said.            

"The extent to which electronic data can be effectively used in construction claims litigation is directly attributable to the extent to which electronic systems are used in construction today," Fordham said. "Electronic discovery can play a significant role in all three areas of the construction claims process – entitlement, causation and quantum," he added.
