E-DISCOVERY AFTER THE 2006 FRCP CHANGES

In December 2006 several changes to the Federal Rules of Civil Procedure involving electronic discovery became effective. The adoption of these changes are designed to expressly address the unique issues associated with electronic discovery and formally marks the elevation of electronic discovery from a best practice to potentially malpractice for those not appropriately employing these new techniques.

K&F Consulting has developed a one hour presentation about the recent FRCP changes on e-
Discovery that has been approved for CLE credit by the State Bars of Georgia and Florida, but can be presented in any state in the southeast. The presentation covers:

I. Preservation
A. Duty, need and timing
B. Determining scope
C. Methods for workstations, laptops, servers, cell phones, application databases,
etc.

II. Production
A. Discovery planning
B. Issues in the new rules
C. Other issues that are not in the new rules
D. Gaining efficiency

III. Analysis
A. Validating the production
B. Data hiding
C. Finding the smoking gun

As part of the presentation participants will receive presentation slides and a 50 page narrative discussing preservation, production and analysis of Electronically Stored Information (ESI).

The presenter is one of K&F Consulting’s Founders, Mr. Gregory L. Fordham. Mr. Fordham is a frequent writer and speaker on electronic discovery. He is a Certified Public Accountant (CPA), Certified Internal Auditor (CIA), Certified Computer Examiner (CCE), Security Plus Certified, Microsoft Certified Professional, Stego and Live. In addition, he has testified as an expert witness in numerous state and federal cases about electronic discovery, computer forensics, and construction claims.
