Preserving Electronically Stored Information Under the New Rules

Electronic evidence is more fragile than its paper counterpart.  Simply continuing to use a computer can destroy relevant evidence. Consequently, it is imperative that preservation be done quickly. The precise preservation techniques are also important, however.  Choosing an inadequate preservation method can impeach the authenticity of the evidence or worse.  This presentation examines the best practices and electronic evidence preservation techniques and not only explains how to do it right but how to do it on a budget. 

This one hour presentation outlines how to properly preserve ESI to help you avoid sanctions and other unfavorable decisions. The presentation will cover:

I. Sending a Preservation Letter

II. Identifying Data Sources

III. Preservation Methods

IV. Documentation

V. Interviewing the Client

As part of the presentation participants will receive presentation slides and a 22 page narrative discussing preservation of Electronically Stored Information (ESI). In addition, you will receive model preservation forms for both opposing side preservation and client preservation instructions as well as a sample questionnaire that can be used to identify the data that should be preserved.

The presenter is one of K&F Consulting’s Founders, Mr. Gregory L. Fordham. Mr. Fordham is a frequent writer and speaker on electronic discovery. He is a Certified Public Accountant (CPA), Certified Internal Auditor (CIA), Certified Computer Examiner (CCE), Security Plus Certified, Microsoft Certified Professional, Stego and Live. In addition, he has testified as an expert witness in numerous state and federal cases about electronic discovery, computer forensics, and construction claims.
